The term “APPs” refers to the Australian Privacy Principles outlined in the Privacy Act 1988 (Cth). “DCH” refers to Destiny Custom Homes, the trading name of Destiny Custom Homes Pty Ltd. “We,” “us,” and “our” refer to Destiny Custom Homes Pty Ltd.
The “Website” refers to the website with the URL www.dchnsw.com.au. “Personal Information” is defined in paragraph 3 of the Privacy Policy and includes Sensitive Information.

WHO WE ARE

Destiny Custom Homes Pty Ltd is a private limited company registered under the corporation act in NSW Australia. DCH may need to collect and use Personal Information about its clients and is committed to protecting their privacy and complying with applicable privacy laws.
The purpose of this Privacy Policy is to inform clients how the company will process their Personal Information and the measures it has put in place to ensure its protection.
By using the Website, receiving services from the company, or contracting with them, clients consent to the collection, use, disclosure, and transfer of their Personal Information as outlined in this Privacy Policy. This statement emphasizes the importance of client consent in the company’s data processing practices.

PURPOSE OF OUR POLICY

Destiny Custom Homes is bound by the Privacy Act and other relevant privacy laws in Australia. The policy outlines the principles by which the company collects, stores, uses and discloses Personal Information, as well as clients’ rights concerning their data.

The Privacy Policy clarifies that the term “Personal Information” will refer to both Personal Information and Sensitive Information in the document, but that DCH will not collect Sensitive Information unless it is required by law or the individual consents to its collection. This statement indicates the company’s commitment to protecting sensitive data and obtaining consent before collecting such information.

COLLECTING PERSONAL INFORMATION

DCH collects Personal Information as defined by the Privacy Act, which includes any information or opinion about an identified individual, or a reasonably identifiable individual, whether the information is true or not and whether it is recorded in a material form or not. Subject to applicable law, we may collect your Personal Information in a variety of ways, which include:

  • From any contract, you enter into with Destiny Custom Homes.
  • On forms completed by you and submitted to DCH.
  • Web-based enquiries you submitted to DCH.
  • Referred to Destiny Custom Homes via paid or unpaid referral or agents.
  • Your use of the Website (including browsing).
  • From any correspondence, you post to DCH.
  • Over the telephone or Via facsimile, email or other electronic communication you transmit to Destiny Custom Homes.
  • Financial Details: Collecting financial details is necessary for DCH to facilitate payment transactions for services rendered to our customers. Examples of financial details that we may collect from you include your bank account details or credit card information. However, where possible, DCH will seek your consent to use the information for a specific purpose.
  • Sensitive Information: It is important to note that the collection of sensitive information, including information about an individual’s ethnicity or racial origin, is subject to additional legal requirements and restrictions under the Privacy Act. DCH will only collect sensitive information where it is necessary for the purpose for which it was collected, and with the individual’s consent or where otherwise permitted by law. DCH will also take appropriate measures to ensure that sensitive information is kept secure and confidential.
  • In some cases, it may be necessary for us to collect your Personal Information in order to provide the services you have requested. For example, if you request a quote for a custom home design, we may need to collect your contact information, such as your name and email address, in order to provide the quote and communicate with you about the project. If you choose not to provide this information, we may not be able to provide the services you have requested.

WEBSITE INFORMATION

It is correct that DCH may collect information through your use of the Website, including click stream data, which refers to the dates and times you access the Website, the domains from where you visited the Website, your activity on the Website and internet protocol addresses. The purpose of collecting this information is to analyse trends and statistics to improve the Website.
DCH may use cookies to collect click stream data, which is a text file sent by the Website to your browser and stored on your computer to identify your computer. If you disable cookies, some parts of the Website may not function properly or at all. DCH may also use web beacons, which are clear-pixel images that generate a notice of your visit to be sent to DCH.
If you choose not to provide the Personal Information that DCH requests from you, or you request to provide such information anonymously, DCH may not be able to provide the information or the services you requested. Where the Website usage information is de-identified data, the APPs do not apply.

HOW IS PERSONAL INFORMATION USED

DCH will only use the personal information it collects for the purposes for which it was collected or for purposes that are related and reasonably expected by the individual, or for purposes to which the individual has consented. This is in accordance with the Australian Privacy Principles under the Privacy Act. More specifically, your personal information may be used for the following purposes:

  • to research, develop, improve and use within our products and services and by its outsourced service providers to provide and improve their services.
  • to respond to an enquiry or provide our services, products or assistance that you request from us.
  • to pre-populate / customise/provide shortcuts on our websites.

  • for feedback, reviews and ratings.
  • to promote and market special offers and other services to you (if you do not want to receive these, please let us know by contacting our Privacy Officer or using the unsubscribe facility in a direct marketing communication sent to you).
  • for purposes connected with the operation of any related or associated companies.
  • for staff training and quality assurance.to aggregate personal information with our third-party partners to personalise the advertising you receive from us and them and to contact winners of trade promotions run by DCH.

REMARKETING

We also use cookies for marketing purposes. If you leave the Website to visit another website or perform a relevant keyword search, you may be served our ad.

MAY PERSONAL INFORMATION DISCLOSE TO THIRD-PARTY

DCH may disclose personal information to individuals and organisations other than DCH. The organisations to which we may disclose personal information include:

  • any related and/or associated companies and their staff.
  • individuals and organisations if you submit an enquiry or seek or acquire certain services through DCH – depending on your enquiry or the services being sought or acquired, these may include:
  • original equipment manufacturers
  • operators of third-party websites, co-branded websites and other third parties
  • financial service providers
  • insurance service providers
  • payment services providers
  • outsourced service providers who assist any of the above persons to provide services;
  • outsourced service providers who assist DCH to provide its services including
  • entities to whom you request we send your information
  • resellers of DCH’s services or products
  • to assist government or regulatory authorities or police; and as we are required by law, for example, under a subpoena or by unclaimed money legislation
  • If you do not want DCH to disclose your personal information to these individuals and organisations, you should not submit an enquiry or acquire those services

When DCH discloses your personal information to a third party, it is important to note that your information will be handled by that third party according to their own privacy policy, which may be different from DCH’s privacy policy.
DCH will also take reasonable steps to ensure that any data service providers to whom they disclose personal information comply with the Privacy Act and the APPs. This means that DCH will only disclose personal information to service providers who have adequate privacy and security measures in place to protect the information.

THE CONSEQUENCES OF NOT PROVIDING US WITH PERSONAL INFORMATION

If you choose not to provide the personal information requested by DCH, it may not be able to provide you with certain services, such as quoting or constructing your home, or the Website functionality may be limited. In some cases, DCH may not be able to fulfil its obligations to you or may be prevented from providing you with the requested products or services.

STORAGE OF DATA AND OVERSEAS DISCLOSURE

We will typically store electronic records of your Personal Information using cloud technology or by other electronic means. We do not store any Personal Information outside of Australia but may send Personal Information to third parties located outside of Australia as further detailed in this section. We may transfer your Personal Information to our service providers located in countries outside of Australia including Thailand and China. You consent to your Personal Information being disclosed outside of Australia, including in these locations. While DCH has privacy rules in place to protect your Personal Information, the overseas recipient may not be subject to privacy obligations or any principles similar to the Privacy Act or the APPs. We cannot always control how these overseas recipients handle the Personal Information that we disclose to them. If you have any concerns regarding the transfer of your Personal Information overseas, or if at any time you wish to withdraw your consent, you should contact our Privacy Officer. However, if you withdraw your consent, we may be unable to fulfil one of the above purposes for which we collect Personal Information.

MAINTAINING THE INTEGRITY, CURRENCY AND SAFETY OF YOUR PRIVACY INFORMATION

DCH takes all reasonable steps to ensure that the Personal Information we hold is accurate, complete and up-to-date. We also take reasonable steps to protect your Personal Information from misuse, interference, loss, unauthorised access, modification or disclosure.
We implement a range of physical, electronic and managerial measures to ensure that your Personal Information is protected from unauthorised access or disclosure, including restricting access to personal information to those who need access to it for a legitimate purpose, such as providing services to you or performing our legal obligations.
We regularly review and update our security measures to ensure that they remain effective and appropriate.
If we no longer require your Personal Information for a particular purpose and are not required to retain it by law, we will take reasonable steps to destroy or de-identify it in a secure manner.

DCH takes reasonable steps to ensure that the Personal Information it collects, uses and discloses is accurate, complete and up-to-date. DCH relies on you to advise us of any changes to your Personal Information. You can do this by contacting us directly.
If DCH is satisfied that the Personal Information is inaccurate, incomplete or out-of-date, we will take reasonable steps to correct the information within a reasonable period of time. Where necessary and appropriate, DCH will also advise other parties to whom we have disclosed the information, of any corrections made.

DCH takes reasonable steps to ensure that your personal information is protected from misuse, interference, loss, unauthorised access, modification or disclosure. We use a variety of physical and electronic security measures to protect the security of your personal information, including restricted access to our offices, secure storage facilities, firewalls, password-protected servers and encryption of sensitive data.
We also require our third-party service providers to implement appropriate security measures to protect any personal information that they may access or handle on our behalf.
However, it is important to note that no method of transmission or storage of information over the internet is completely secure, and DCH cannot guarantee the absolute security of your personal information. We will promptly notify you if we become aware of any security breach that may have compromised your personal information, in accordance with our obligations under the Notifiable Data Breaches scheme.

DATA BREACHES

A data breach occurs when there is unauthorized access to or disclosure of personal information. DCH takes the protection of your personal information seriously and has measures in place to prevent data breaches. However, if a data breach does occur, DCH will comply with its obligations under the Notifiable Data Breaches scheme.
Under this scheme, if a data breach occurs and it is likely to result in serious harm to you or other affected individuals, DCH will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable after becoming aware of the breach.
DCH will take all reasonable steps to contain the breach and assess the risks associated with the breach. We will also take steps to prevent similar breaches from occurring in the future. If you have reason to believe that your personal information has been compromised or there has been unauthorized access to your personal information, please contact DCH immediately.

UPDATES TO THIS PRIVACY POLICY

DCH may update this Privacy Policy at any time, and the updated version will be posted on the Website. If the updates involve material changes to how DCH collects, uses, or shares your Personal Information, DCH may notify you by email or mail. In most cases, if the updates are minor, your consent will not be required. However, if the updates affect a part of the policy that requires your explicit consent, DCH will inform you and obtain your consent before implementing the changes. By continuing to use the Website after any changes to this Privacy Policy, you agree to be bound by the updated terms.

Accessing and correcting your Personal Information

DCH values your right to access and correct your personal information. You have the right to request access to your personal information held by DCH at any time.
DCH will provide you with access unless an exception applies under applicable privacy law. If an exception applies, DCH will advise you in writing of the reason for the refusal and how you may complain about the refusal.
If you notice any inaccuracies in your personal information or need to make a change or verify such information, you may contact DCH with a request to access your personal information, providing sufficient information to verify your identity. If your personal information has been previously disclosed to a third party, DCH will notify the relevant third parties of the correction.
If there is a reason for DCH not to provide you with any of your personal information, DCH will provide you with a written notice of the refusal, setting out the reasons (except to the extent it would be unreasonable or unlawful to do so), and advise you of the mechanisms available to complain about the refusal.
DCH reserves the right to charge an administrative fee to cover its reasonable costs for providing access to your personal information, subject to applicable law. DCH will endeavour to respond within a reasonable period, which is expected to be no more than 30 days.
If DCH does not agree that your personal information is inaccurate, at your request, DCH will attach a note stating that you disagree with the relevant material.
Finally, you may inform DCH if you withdraw any consents that you have previously provided to them.

LODGING A COMPLAINT

If you have any concerns or complaints regarding DCH’s handling of your Personal Information, you can contact their Privacy Officer who will aim to resolve the issue and respond to your complaint in a reasonable time frame. If you are not satisfied with their response, you may also make a complaint to the Office of the Australian Information Commissioner (OAIC).
